1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

2. ROLL CALL:
Members Present: Town Chairman William Goehring, Town Supervisors Lester Miller, William Miller, James Fahney

3. APPROVAL OF MINUTES: Motion by L. Miller, seconded by Fahney, all voting in favor to approve the minutes from the July 7, 2009 meeting as presented, motion carried 4-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the financial report as presented, motion carried 4-0.

5. PUBLIC INPUT: Kerry Lynch commented on road conditions after a neighbor’s landscaping project.



6. BUILDING INSPECTOR REPORT: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the building inspector’s report as presented. Motion carried 4-0.

7. CONSTABLE REPORT: In the constables absence, Inspector Mayer noted that while checking on a possible building permit violation, he found that the property at N1976 (or N1979) Bates Road was indeed creating living space in an agricultural building. They were ordered to stop work, and a camper-trailer was ordered removed. Members of audience further claimed that they have witnessed the disposal of deceased animals on the property. Clerk/Treasurer Klatt was instructed to contact the Sheboygan County Health and Human Services Division of Public Health to report. Further consensus of the board was to instruct Constable Kreutzinger to assess the situation, jointly attending with a member of the Sheboygan County Sheriff’s Department.

9. NEW BUSINESS:
a. Lisa Reeder, Complaints of Dogs Running at Large: Ms. Reeder noted that the prior complaints made against her dogs running at large (see minutes of July 2009 meeting) may have been in error, and that she was in control of her animals at the time of the complaint. She noted that there is another dog within one-half mile of her property that is extremely similar in appearance to her dog. The board agreed to make Constable Kreutzinger aware in the event there are further complaints.
b. Dale Mueller, Adell Fire Department, Request for Funding Assistance: Chief Mueller explained to the board the need for replacing a 1972 engine. With the financial assistance of the Village of Adell, the department is purchasing a used engine from the Village of Whitelaw, and is asking the Town of Sherman for the same. Chairman Goehring noted that it has been past practice to increase the fire departments’ contribution by 3% each year, and by doing so, it is to eliminate the individualized assistance to each of the three departments it supports. Motion by Fahney, seconded by Mueller, all voting in favor that the efforts are very much appreciated, however, funds are not available to assist the purchase, motion carried 4-0.

10. TOWNCHAIR REPORT: Items for discussion only.

11. REPORTS OF TOWN COMMITTEES:
a. Boehlke & W. Miller, Transfer Station: Nothing to report on this item.
b. L. Miller & Fahney, Roads: Miller has not yet heard from Scott Construction for the East/West Bates Road seal coating project as to when it will begin. The site triangles have been mowed on town roads. A few complaints have been heard about other areas that were not mowed (due to budget constraints) and consensus of the board was to appreciate any property owner who would mow their areas themselves.
c. Bill Beverly, Plan Commission: Nothing to report on this item.
d. Dennis Hiller, Park Board: Via email, Hiller reported that some potential improvements would be appreciated, and include picnic tables, town payment for bathroom facilities, rope ladder, and garden shed. Chairman Goehring stated that once the final plat is approved for Country Meadows Estates, funding is to be provided to the town for park improvements; until then, the town is unable to fund such improvements but will consider such during the preliminary budget process.
