1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.
2. ROLL CALL:
Members Present: Town Chairman William Goehring; Town Supervisors Lester Miller, William Miller, James Fahney, and Robert Boehlke
Members Absent: none
Others Present: Clerk/Treasurer Rhonda Klatt, Sheboygan County Highway Commissioner Greg Schnell, Veolia Representatives Michael Thun and Scott VanHaveren, Building Inspector Frank Mayer, Sounder Reporter Rodney Schroeter, and Bernadette Mondloch
3. APPROVAL OF MINUTES: Motion by L. Miller, seconded by W. Miller, all voting in favor to approve the minutes from the November 3, 2009 meeting as presented, motion carried 5-0.
4. APPROVAL OF FINANCIAL REPORT: Motion by L. Miller, seconded by Fahney, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: No comments were heard
6. BUILDING INSPECTOR REPORT: Motion by Fahney, seconded by Boehlke, all voting in favor to approve the building inspector’s report as presented. Motion carried 5-0.

7. CONSTABLE REPORT: No action taken on this item.
8. NEW BUSINESS:
Greg Schnell, Sheboygan County Highway Commissioner: Mr. Schnell reported to the board that the county highway department had an operational analysis performed in 2008 that showed the department was overstaffed with the ability to downsize. 117 employees were employed in 2006 and 108 are projected for 2010. “While the county highway department appreciates the town’s business, and would like to continue serving the town, we will possibly be closing the Adell shed (located on CTH A) in spring of 2010, and all town jobs will come from the Cascade shed, approximately 5-7 miles further away. Because of the distance change, Sherman will not see a major influx of expenditures from the county.” No further action taken on this item.
d. Bid Opening; Trash & Recycling Hauling Proposals: Motion by L. Miller, seconded by Boehlke, all voting in favor to approve the only bid received from Veolia Environmental Services, motion carried 5-0. New contract proposal includes $150/load for all transportation and $50 per ton (includes new tax) for disposal of trash and $175 per ton for disposal of tires. Veolia will continue to rebate the town the metal revenue. Fuel surcharge will be added when diesel fuel rises above $3.00 per gallon. Veolia will calculate the number of containers dumped for the month and apply a surcharge percent to the transportation of the refuse and recycling. The rates will be firm for 1 year. Years two and three the rates will increase 3% each year. Mr. Thun will be supplying a new contract to the town clerk for the town file.

NOTICE TO MUNICIPAL OFFICIALS, EMPLOYEES AND INDEPENDENT CONTRACTORS
Wherefore, the Town Board of the Town of Sherman in Sheboygan County, has, by adoption of this Resolution, approved the creation, use and maintenance of a municipal Website for a public purpose and as a public benefit, and has approved this Notice contained herein to be provided by the municipal clerk to the appropriate municipal officers, employees and independent contractors. This Notice is provided by the Town of Sherman to the appropriate municipal officers, employees and independent contractors specifically related to the proper supervision and future use and the maintenance of the Website by those appropriate officers, employees and independent contractors.
NOTICE
Whereas, the created municipal Website should be properly supervised by the municipal officers, or their designees, and should not be used nor maintained by any municipal officer, employee or independent contractor to allow knowingly any content or material on the municipal Website that demonstrates any defamatory statements, an invasion of the privacy of any person, any violation of a trademark or copyright, any obscene or pornographic materials or any type of criminal activity.
Whereas, in addition, this Website should be properly supervised by the municipal officers, or their designees, and not be used nor maintained by any municipal officer, employee or independent contractor to allow any one (1) of them knowingly to use or maintain the Website for any illegal political use or activity, any unethical use or activity, any unauthorized commercial use or activity or any unauthorized municipal government use or activity on the Website. The Town Board or its designee(s), by this Notice, shall be authorized to timely approve, amend, disapprove or terminate in total the content of the Website and to order any inclusion or material deletion of content or material on the Website.
Whereas, finally, that the Town Board by this Notice, determines that the Website, as now created, shall be used and maintained only for a public purpose. That the Town Board by adoption of this Resolution, confirms that the expenditure of municipal public funds and the creation, use and maintenance of this Website, was and still is for a public purpose and public benefit, and that any and all future uses and activities involving this Website must have a public purpose and must serve a public benefit for the municipality, its residents, its taxpayers and its visitors.
Be it resolved that the Town Board of the Town of Sherman in the County of Sheboygan, does adopt this Resolution on the 1st day of December 2009 and orders, by this Resolution, the municipal clerk to provide this Notice in writing contained herein to the appropriate municipal officers, employees and independent contractors, specifically the following:

f. Appointment of Election Workers: Motion by Boehlke, seconded by L. Miller, all voting in favor to appoint Carol Voeks, Lorna Marquardt, Virginia Dowty, Chris Maurer, Marilyn Miller, Nancy Schroeter, Jan Habeck and Elaine Oskey as poll workers for the term January 2010 through December 2011, motion carried 5-0.
g. Liquor, Cigarette and Operator Licenses: No licenses to approve at this time.

10. REPORTS OF TOWN COMMITTEES:
i. Boehlke & W. Miller, Transfer Station: Nothing to report at this time.
j. L. Miller & Fahney, Roads: Miller had applied for TRIP and LRIP grants for reconstruction of 2 miles of Abbot Drive; neither was approved. TRIP-D was applied for 5 miles of Abbott Drive.
k. Bill Beverly, Plan Commission: The next plan commission meeting will be held on Thursday, December 10, 2010 at 7:45 p.n.
l. Dennis Hiller, Park Board: No action taken on this item.
11. MISCELLANEOUS BUSINESS:
m. Clerk’s Communications: Clerk/Treasurer Klatt noted that the website should be live after the first of the year. She will present it to board members at the January meeting.
