1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:03 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

2. ROLL CALL:
Members Present: Town Chairman William Goehring, Town Supervisors Lester Miller, William Miller, Robert Boehlke and James Fahney
Members Absent: none
Others Present: Clerk/Treasurer Rhonda Klatt, Jason Vorpahl, Larry Weidig, Plan Commission Chair Bill Beverly, Kerry Lynch and Reporter Bernadette Mondloch

3. APPROVAL OF MINUTES: Motion by Boehlke, seconded by Fahney, all voting in favor to approve the minutes from a special meeting on December 18, 2008 and a regular meeting on January 6, 2009, as corrected, motion carried 5-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by W. Miller, seconded by L. Miller, all voting in favor to approve the financial report as presented, motion carried 5-0.

6. BUILDING INSPECTOR REPORT:

7. UNFINISHED BUSINESS:
a. Approve Signature: Motion by Boehlke, seconded by Fahney, all voting in favor to approve the signing of the Adell Fire Department 2009 contract, which was presented at the January meeting, motion carried 5-0.

b. Appointment of BOA Member: Item tabled until next meeting.

8. NEW BUSINESS:
a. Vorpahl CUP Request: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the conditional use permit request from Jason A. and Connie M. Vorpahl to change the use of existing radio communications tower from personal use to commercial wireless communications use on property at W6239 County Road SS, Random Lake, Town of Sherman, with the following conditions, motion carried 5-0:
1) The C.U.P. shall not be assignable and when Jason A. Vorpahl sells the subject real estate, the permit shall automatically expire.
2) The C.U.P. shall exist for a term of two (2) years, at which time applicant shall return to the Town of Sherman for renewal.
3) In the event that the tower structure is damaged to the extent of 50% of its insured value, this permit shall be terminated and applicant shall not replace or repair said tower until a new permit is applied for and granted.
4) Applicant shall not add new uses to the tower by adding additional equipment without consent of the Town Board of the Town of Sherman.

b. Sprinkmann Response to Tower Inquiry: Responding to a request sent by Clerk/Treasurer Klatt regarding his two towers on his property at N1347 Lynn Road, Todd Sprinkmann explained in letter form:
“The first tower – the taller one- went up in the fall of 2003. Prior to its construction, I was advised by the Town Board that I would need to come to a meeting and apply for or obtain a permit. I brought detailed engineering drawings, brought an aerial photo of our property showing that the tower wouldn’t encroach on anyone’s lot lines, and answered various questions that board members had. After 15-30 minutes, I was informed that the tower was approved and I distinctly recall Mr. Beverly saying “No permit is necessary.”
In the summer of 2005, I added new ham radios on different bands, and I had to use different antennas. My tower construction expert advised that it would be unsafe to overload my existing tower. Len Kreyer of Skywave Tower, Inc. in Arlington, WI and I agreed that a new tower would be necessary. Since no per was necessary for the construction of the 1st tower, I went ahead and put up the 2nd tower in the late summer of 2005. That one is the shorter of the two towers.”
Boehlke and Beverly stated that the Plan Commission originally said that Sprinkmann was given permission to put up the first tower, but not the second. The ordinance was in place before the second tower was constructed. It is the consensus of the board to have Clerk/Treasurer notify Sprinkmann that a conditional use permit is necessary for the second tower.

c. Deny Mail Delivery: Motion by L. Miller, seconded by W. Miller, all voting in favor to have the board sign a request to be given to former clerk, Bernadette Mondloch, to discontinue accepting any mail regarding the Town of Sherman from this date forward, motion carried 5-0. A letter was signed and handed to Mondloch, which stated that if she should receive mail for the township, she is to refuse and return to sender, sending a strong message to the sender to correct the address.

d. Operator’s License: Motion by Boehlke, seconded by Fahney, all voting in favor to approve an operator’s license for Jennifer Fitzgerald, 113 Wisconsin Street, Adell, Greene’s Bar & Grill. Motion carried 5-0.

e. Next Regular Meeting Date: The next regular monthly meeting will be held on Tuesday, March 3, 2009 at 7:00 pm.
