1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:03 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.
2. ROLL CALL:
Members Present: Town Chairman William Goehring, Town Supervisors Lester Miller, William Miller, Robert Boehlke and James Fahney
Members Absent: none
Others Present: Clerk/Treasurer Rhonda Klatt, Building Inspector Frank Mayer, Plan Commission Chair Bill Beverly and Reporter Bernadette Mondloch
3. APPROVAL OF MINUTES: Motion by Fahney, seconded by W. Miller, all voting in favor to approve the minutes from December 2, 2008, motion carried 5-0.
4. APPROVAL OF FINANCIAL REPORT: Motion by Fahney, seconded by L. Miller, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: No comments were heard.
6. BUILDING INSPECTOR REPORT: Inspector Frank Mayer presented the annual list of 32 permits, which included only one single-family home.
7. UNFINISHED BUSINESS: none
8. NEW BUSINESS:
a. Robert Boehlke, Rezone request from A-1 to A-4, and CSM Approval: Discussion was held regarding the request.
Boehlke: The value of this lot was deducted from the selling price of the farm. The original intention was to build a retirement home.
Fahney: I just think that by allowing a 20-acre parcel to have a building site will just open a can of worms, with our 35-acre and all.
Beverly: If the township wants open space, we don’t want people selling lots off for development. (The plan commission’s) point of recommending this was to keep open space. (The plan commission) feels that the town is better off doing it this way.
Goehring: Do you think the DNR would have allowed you to keep 20-acres if you weren’t going to build a retirement home on it? (Goehring had presented a letter from Dale Katsma, DNR, stating that the conservation and Development Rights Easements put restrictions on certain uses and practices on land are filed with the deeds for the land parcels. They restrict what the landowner can do with his/her land, but they don’t affect local zoning regulations or ordinances.)
Boehlke: The contract stated I could keep one building site – it ended up being 20 acres. I just want to preserve the building site.
Motion by Fahney, seconded by W. Miller, Boehlke abstaining, all voting in favor to approve the rezone request from A-1 to A-4 with a deed restriction stating that only Boehlke, his spouse and/or children will be allowed to build on this site, in keeping with the current zoning ordinance. Motion carried 4-0.
b. BOA Appointments: Item tabled until next meeting.
c. Salvage and Junk Dealers License Renewals: Motion by Fahney, seconded by W. Miller, all voting in favor to approve Salvage and Junk Dealers Licenses for 2009 to Chester Sowin, Kaiser Wrecking, Murre Salvage and Jesse Bleisner. Motion carried 5-0.
d. Candidate Name Placement: In preparation of the April 7, 2008 Spring election, a drawing of two names resulted in the following ballot placement: (1) Lester Miller, Town Supervisor; and (2) William Miller, Town Supervisor.
e. Operator’s License: Motion by L. Miller, seconded by Boehlke, all voting in favor to approve an operator’s license for Jessica Schweiger, Greene’s Bar & Grill. Motion carried 5-0.
f. Next Regular Meeting Date: The next regular monthly meeting will be held on Tuesday, February 3, 2009 at 7:00 pm.
