1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

2. ROLL CALL:

3. APPROVAL OF MINUTES: Motion by W. Miller, seconded by Boehlke, all voting in favor to approve the minutes from the June 2, 2009 meeting as corrected, motion carried 5-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by L. Miller, seconded by Fahney, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: Bernadette Mondloch was contacted by a resident who was questioning a possible living situation in a camper trailer on a property located near the intersection of County A and Bates Road. Constable Kreutzinger was instructed to check into it, and report at next months meeting.

6. BUILDING INSPECTOR REPORT: Discussion was held regarding the home building permit that was approved by Mayer on Klein Lane. Mayer explained that due to drainage issues the home was approximately 35 feet more than the 300 feet allowed under the Ordianance from the road. Discussion ensued with the clarification that the Ordinance requires a home to be within 300 feet of a road---defined as town, county or state road. A private road or driveway does not meet the town’s definition of a road. Mayer will measure the distance himself in the future, and will sign a certification on the permit stating such.

7. CONSTABLE REPORT: Constable Kreutzinger reported that Brian Reeder was issued a citation for dogs at large for $200, which was paid. The constable has received three additional calls over the July 4th Weekend with complaints that the dogs are at large again. It was the consensus of the board to have the constable issue another citation, in the amount to be determined by the constable, when the next complain comes in.

8. UNFINISHED BUSINESS:
a. Dave Eggert, Country Meadows Estates:
i. Change in retention ponds: Discussion was held with JE Arthur & Associates Representative Eric Otte who presented copies of a new storm water plan for the subdivision. The new pan was created due to ground water issues that arose. “The original plan did not work mainly due to a miscommunication between the Developer’s engineering firm and the testers of the soil. Groundwater table is extremely hard to find in this type of “gravely” soil. The large, infiltration basin on the old plan will now be a traditional storm water retention pond, which eliminates dependence on groundwater infiltration.” Sheboygan County and WI DNR have each approved the final plat of the subdivision, which included the original storm water plan, and were based on the 100-year flood plain (Sheb. Co. requirement) and a 2-year plan (DNR requirement). (Both requirements included the amount of discharge cannot be increased.) Motion by W. Miller, seconded by Boehlke, all voting in favor to table the item until the September meeting, allowing the Plan Commission to review and pending receiving the final plat, motion carried 5-0.
ii. Parkland Fees: no action taken on this item
iii. Assessment Designation: While working with the municipal assessor, the property owners are working to get the land back to a crop. (Land must be cropped once per year in order to keep it in agricultural assessment.)

9. NEW BUSINESS:
a. Dale Katsma, DNR Access to Spring Lake: Wisconsin DNR may be interested in purchasing approximately 2.7 acres, currently zoned A-1, to create public access to Spring Lake. The board advised him to apply for rezoning, and follow the correct steps in obtaining the change. No further action taken on this item.
b. Citizen Request to Ignite Fireworks: Jared Dahm and Brittni Hein requested permission to ignite fireworks. Fire Chief Todd Stange responded via email that he would not authorize permission on behalf of the Silver Creek Fire Department. It was noted that a dispute is already ongoing between the individuals who wish to ignite fire works and their neighbors to the NW who live in close proximity. Town Chair Goehring stated he will not authorize permission, based on the authority given by state statute. 167.10(3)(a) No person may possess or use fireworks without a user's permit from the mayor of the city, president of the village or chairperson of the town in which the possession or use is to occur or from an official or employee of that municipality designated by the mayor, president or chairperson. No person may use fireworks or a device listed under sub. (1) (e) to (g) or (i) to (n) while attending a fireworks display for which a permit has been issued to a person listed under par. (c) 1. to 5. or under par. (c) 6. if the display is open to the general public.
c. Todd Sprinkmann, Towers on Property: Sprinkmann informed the board of the purpose of his towers on the property. The first tower was installed without a permit because there was no ordinance at that time. By the time the second tower was installed, the board had in place an ordinance governing this type of structure. Sprinkmann claims he was unaware of the new requirement and had it constructed without a building permit or conditional use permit. The board instructed him to now apply for a conditional use permit to protect himself and the town. Sprinkmann was handed a C.U.P. application, and will return it promptly.
d. 2008 Town of Sherman Audit: Motion by Fahney, seconded by Boehlke, all voting in favor to accept the 2008 Town of Sherman Final Audit as presented from John Perronne, CPA, motion carried 5-0.
e. Liquor, Cigarette and Operator Licenses:
i. Dereck McMunn, 603 South Milwaukee Street, Fredonia: Motion by L. Miller, seconded by W. Miller, all voting in favor to approve the operator’s license for McMunn, motion carried5-0.
f. Next Meeting Date: August 3, 2009

10. TOWNCHAIR REPORT: Items for discussion only.

11. REPORTS OF TOWN COMMITTEES:
a. Boehlke & W. Miller, Transfer Station:
i. Boehlke leveled off the site under the dumpsters and filled in potholes. Dumpsters are now tight up against the walls. He submitted an invoice for his time for $100.00. Motion by Fahney, seconded by W. Miller, all voting in favor to approve payment of the invoice to Robert Boehlke in the amount of $100, motion carried 5-0.
ii. Increase fencing: W. Miller noted that the only way to do a decent job would be to enclose the entire transfer station. No further action taken on this item.
iii. Natural Dump Options: Due to budgetary constraints, this item will be tabled until more of a need arises.
iv. Clerk/Treasurer Klatt was instructed to contact the Sheboygan County Planning Department to obtain a fire number for the transfer station.
b. L. Miller & Fahney, Roads: The bid from Scott Construction (approved at the June 2009 meeting) was accepted by Scott to not exceed $9126. $15,526 of TRIPP funds were transferred from Abbott Drive to Random Lake Road. Site triangles at intersections must be mowed by the County Highway Department.
c. Bill Beverly, Plan Commission: A meeting will be scheduled for Thursday, August 13 for Sprinkmann’s C.U.P and Katsma’s request for DNR public access to Spring Lake. Supervisor Boehlke recommended that the Plan Commission suggest a stiffer penalty be in place if any work is done before a permit is taken (in the case of Todd Sprinkmann). Beverly asked that it also be placed on the agenda.
d. Dennis Hiller, Park Board: Via email, Hiller reported that the “no dumping” signs have been installed, and a garbage can purchased and is being used properly.

12. MISCELLANEOUS BUSINESS:
a. Clerk’s Communications: Clerk/Treasurer Klatt mentioned to the board of the upcoming WTA meeting on Friday, July 17 at the Town of Rhine.

13. ADJOURN: Motion by W. Miller, seconded by Fahney, all voting in favor to adjourn. Motion carried 5-0. Time: 9:09 pm
