1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department. Some items may have been taken out of agenda order as announced at the start of the meeting.

2. ROLL CALL:
Members Present: Town Chairman William Goehring; Town Supervisors Lester Miller, William Miller, James Fahney and Robert Boehlke
Members Absent: none

3. APPROVAL OF MINUTES: Motion by L. Miller, seconded by Fahney, all voting in favor to approve the minutes from the April 6, 2010 monthly meeting as corrected, motion carried 5-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by W. Miller, seconded by Boehlke, all voting in favor to approve the financial report as presented, motion carried 5-0.

7. CONSTABLE REPORT: No action taken on this item.

8. UNFINISHED BUSINESS:
a. Multiple Dog Ordinance: The committee, Lester Miller, Jim Fahney & Rhonda Klatt, will be meeting within the next week or two to work on the ordinance. No further action taken on this item.

9. NEW BUSINESS:
a. Nancy Andrews, Proposed New Business: No action taken on this item since Andrews had requested on the afternoon of May 4, 2010 to be removed from the agenda.
b. Efrem Capetillo, Proposed Accessory Building Construction: Mr. Capetillo is the owner of approximately 52 acres at the southeast corner of the intersection of County Highways A & I. There is currently a small shed on the property. He would like permission from the board to be allowed to build a larger storage building to house equipment needed for maintaining and using the property. It was the consensus of the board to allow Mr. Capetillo to “construct” a temporary shed, a.k.a. “shed-in-a-box”, but nothing permanently. (see #11(d)(i) below)
c. Liquor License Application: Motion by W. Miller, seconded by Fahney, all voting in favor to grant a “Class B” Combination Beer & Liquor licenses to Cheryl Kay Scholz, Petticoat Junction, W6498 State Highway 144, Random Lake, to expire June 30, 2010. Motion carried 5-0.
d. Board of Appeals Appointments (3): Motion by Goehring, seconded by Boehlke, all voting in favor to reappoint Don Kies, Ed Filemyr and Kyle Junge to the Board of Appeals for a three (3) year term, expiring April 2013. Motion carried 5-0.
e. Transfer Station and Road Committee Appointments: Motion by Goehring, seconded by W. Miller, all voting in favor to reappoint William Miller and Robert Boehlke to the Transfer Station Committee. Motion carried 5-0. Motion by Goehring, seconded by W. Miller, all voting in favor to reappoint Lester Miller and James Fahney to the Road Committee. Motion carried 5-0.
f. Dog Licenses Late Fees: Motion by Boehlke, seconded by W. Miller, all voting in favor to approve the late fee letter to be mailed to residents who have not paid all appropriate fees assist the clerk/treasurer in collecting such. Motion carried 5-0.

Payment for the 2010 dog license has been received and your envelope was postmarked as April 6, 2010. By state statute, all licenses are considered late if received on or after April 1, 2010.

I will not be able to issue a license for your dog(s) until all fees have been paid. A list of the names of owners of pets who are not licensed will be turned over to the town constable for collection, and finally with the District Attorney. To avoid any of these events from occuring, please mail the above payment to my office Town of Sherman, P.O. Box 88, Adell, WI 53001.

(5) Late fees. The collecting official shall assess and collect a late fee of $5 from every owner of a dog 5 months of age or over, if the owner failed to obtain a license prior to April 1 of each year, or within 30 days of acquiring ownership of a licensable dog or if the owner failed to obtain a license on or before the dog reached licensable age. All late fees received or collected shall be paid into the local treasury as revenue of the town, village or city in which the license was issued. The governing body of any county, town, village or city may, when setting the amount of the tax, provide that any person purchasing a dog license for a dog 5 months of age or over after April 1 shall pay an additional late fee.
*Prior to 1995, the Town of Sherman passed, by motion, to increase to the late fee from $5.00 to $10.00. The late fee to be collected shall now be $10.00 which is greater than Wisconsin State Statute 174.05(5) declares.

g. Cemetery Gate Repairs: Item tabled until all board member can see the damage before determining best type of repairs. The clerk was ordered to place this item on the June 2010 agenda.
h. Question of Proceeding with Random Lake Road Bike Path Project, Considering Projected Costs: As this project moves forward, Chairman Goehring noted that it is costing more money than what was originally anticipated. For the reconstruction of Random Lake Road, the same contractor would be hired to both the road and the proposed bicycle path along same at a cost of approximately $150,000 for one-half of a mile. Supervisor Lester Miller stated that “(the town) is so far along at this point, we may as well stick it out.” No action taken on this item.
i. Decision on Rural Numbering Signs: The board unanimously decided to give the following information to the county planning department in regards to the new rural numbering signs:
i. Blue in color;
ii. Both the Town and Road Name will be placed on the sign; and
iii. Join in the county bid process for total package (signs & installation) and that the cost be placed on the tax roll.
j. Next Meeting Date: June 1, 2010

10. TOWNCHAIR REPORT: No action taken on this item.

11. REPORTS OF TOWN COMMITTEES:
k. Boehlke & W. Miller, Transfer Station: Supervisor Boehlke presented a list of fees from the Town of Fredonia transfer station, and suggested that Sherman look into raising the fees currently charged. Clerk/Treasurer Klatt was ordered to have the current list of charges available for the next meeting.
l. L. Miller & Fahney, Roads: An invoice will be sent to the town from Sheboygan County for work on the guardrail on Abbott Drive. Clerk/Treasurer Klatt was told to send that to the insurance company when received.
m. Bill Beverly, Plan Commission: The proposed ordinance, an addition (par. 2) to Section 2.3 Building and Other Permits, was reviewed by the board. One minor correction was made, and Clerk/Treasurer Klatt was ordered to publish the proposed ordinance for a public hearing and adoption.
SECTION 2.3 BUILDING AND OTHER PERMITS:
Whenever a building or driveway or other permit is requested under the terms of the Construction Code of the Town of Sherman, the Building Inspector shall first determine that the proposed use of the premises as authorized by said permit will comply in every respect with this ordinance.
On any property for which a permit is to be issued, the residence authorized by the permit shall be already present or under construction before construction of any accessory structures may begin. Any accessory structure shall conform to the applicable regulations of the Town of Sherman.
The Town Board may review any building or other permits issued by the Building Inspector to determine whether the use of the premises under the terms of the permit will comply in every Respect with this Ordinance.
In the event that a Building or other Permit is found by the Town Board to authorize use of the premises which does not comply with this Ordinance, the Building Inspector shall revoke said permit pursuant to the authority granted in paragraph C of Section 1.25 of the Construction Code of the Town of Sherman.

n. Dennis Hiller, Park Board: Hiller not in attendance; nothing to report on this item.

12. MISCELLANEOUS BUSINESS:
o. Clerk’s Communications: Board of Review will meet on May 26 at 6:30 p.m. Office will be closed the week of June 21, 2010.

13. ADJOURN: Motion by W. Miller, seconded by Fahney, all voting in favor to adjourn. Motion carried 5-0. Time: 8:57 pm
