1. CALL TO ORDER: Acting Town Chairman Lester Miller opened the Board of Supervisors Monthly Meeting by calling to order at 7:32 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.
2. ROLL CALL:
Members Present: Town Chairman William Goehring (arriving at 8:29 p.m.), Town Supervisors Lester Miller, William Miller, James Fahney, and Robert Boehlke

3. APPROVAL OF MINUTES: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the minutes from the October 6, 2009 meeting as presented with corrections, motion carried 4-0.
4. APPROVAL OF FINANCIAL REPORT: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: Becky Swanson asked the board if the public should speak now on an agenda item, or if they would be allowed to speak when the item came up. Chairman Miller stated that she would be able to speak then. Rich Bremmer asked members of the board who are also members of the fire department why the ticket prices of the SCFD steak fry went up in price. He was told because the prices of the steaks were higher.
6. BUILDING INSPECTOR REPORT: Motion by Boehlke, seconded by Fahney, all voting in favor to approve the building inspector’s report as presented. Motion carried 4-0.

7. CONSTABLE REPORT: Motion by W. Miller, seconded by Boehlke, all voting in favor to instruct the clerk to forward all remaining non-compliant dog owners names to the district attorney for collection. Motion carried 4-0. In Constable Kreutzinger’s absence, Clerk/Treasurer Klatt mentioned that all but approximately five dog owners are now in compliance with the state licensing law for dogs.
8. NEW BUSINESS:
c. Approve 2010 Insurance Carrier: Motion by Fahney, seconded by W. Miller, all voting in favor to amend the policy for the Silver Creek Fire Department as follows, which would add approximately $700 to the policy premium:, motion carried 4-0.
i. Increase deductible from $500 to $1,000;
ii. Increase value of portable equipment from $151,000 to $250,000’
iii. Increase value of two pumper trucks from $231,000 to $300,000, and $210,000 to $300,000.
Motion by W. Miller, seconded by Boehlke, all voting in favor to approve Rural Mutual Insurance as the town’s insurance carrier for 2010. Motion carried 4-0.
d. Jeff Uecker, Request for permission to construct storage building: Motion by Boehlke, seconded by L. Miller, all voting in favor to approve the construction of a storage building at W6673 S. County Road A, conditional upon personal-use only, and the current dwelling/living quarters (which is a finished portion of existing storage building) may not be rented out at any point in the future, motion carried 5-0. It was further mentioned that Mr. Uecker was not aware of the 300’ setback ordinance for a future dwelling, and was advised by the board of his ability to apply for a variance from the ordinance once he decides to build a home. Mr. Uecker purchased the property with an existing storage building with a portion of it converted into living quarters. Since the purchase, he has upgraded most of the quarters to make it livable. He and his family are currently using the property for a vacation location with plans to make Town of Sherman their year-round home.
e. Town Web Design, New Town Site Quote: Motion by L. Miller, seconded by W. Miller, all voting in favor to approve quote from Dustin Overbeck, Business Manager, Town Web Design, Inc., to provide the Town of Sherman with a website and hosting solution to serve the community at a cost of $310 for both the first and second year of service, motion carried 5-0. Clerk/Treasurer Klatt was instructed to send Mr. Overbeck a copy of the minutes stating such decision.
f. 2010 Joint Powers Agreement: Motion by Boehlke, seconded by L. Miller, all voting in favor to approve the 2010 Joint Powers Agreement with the Sheboygan County Sheriffs Department, motion carried 5-0.
g. Liquor, Cigarette and Operator Licenses: No licenses to approve at this time.

9. TOWNCHAIR REPORT: Items for discussion only.
10. REPORTS OF TOWN COMMITTEES:
i. Boehlke & W. Miller, Transfer Station: Nothing to report at this time.
j. L. Miller & Fahney, Roads: Miller stated the mowing on town roads was complete. Fahney attended a TRIP meeting. Miller will apply for TRIP and LRIP grants for reconstruction of 2 miles of Abbot Drive. (A municipality is eligible to receive either one or the other grant, not both.) The walking trail should be constructed along Random Lake Road in spring/summer 2010; such project will be funded by the Nonmotorized Transportation Pilot Program.
k. Bill Beverly, Plan Commission: Nothing to report at this time.
l. Dennis Hiller, Park Board: Motion by L. Miller, seconded by W. Miller, all voting in favor to approve donation of $200 to the Random Lake Athletic Association to help fund the portable bathrooms at Hiller Park for the 2010 season, motion carried 5-0.
11. APPROVAL AND ADOPTION OF 2010 BUDGET:
m. Motion by Goehring to amend budget by moving funds from the Joint Funding and Snowplowing budgets to assist in funding the library’s additional needed funding, motion died for lack of a second. Motion by Goehring, seconded by Boehlke, all voting in favor to move $778 from Joint Funding and $1000 from County Tax Collection budgets to add to the library’s additional needed funding, motion carried 5-0.
n. Motion by Fahney, seconded by W. Miller, all voting in favor to approve the amended budget, motion carried 5-0.
o. Motion by L. Miller, seconded by W. Miller, all voting in favor to approved the 2009 town tax levy as $1.99/1000 assessed valuation, to be collected in 2010, motion carried 5-0.
12. LAKEVIEW COMMUNITY LIBRARY, REQUEST FOR ADDITIONAL FUNDS: Motion by Goehring, seconded by Boehlke, most voting in favor to approve the library’s request for an additional $1,778.16 to be received in 2010 to keep the library more viable, motion carried 4-1, L. Miller opposed.
13. MISCELLANEOUS BUSINESS:
p. Clerk’s Communications: Clerk/Treasurer Klatt noted that the final population estimate for 2009 was received as 1,571; it is rumored that the county treasurer may not be collecting taxes for any of the county’s municipalities next year; and the trash/recycling RFP’s will be published in The Sounder beginning next week, for approval at the December board meeting.
q. Chairman Goehring further commended Darla Jean Kraus for her Muriel Fuller Award, and the 30+ years of service in the library system. Ms. Kraus thanked the board for their support.
14. ADJOURN: Motion by W. Miller, seconded by Fahney, all voting in favor to adjourn. Motion carried 5-0. Time: 9:03 pm
