1. CALL TO ORDER: Town Chairman William Goehring opened the Budget Public Hearing by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

Members Absent: none
Others Present: Clerk/Treasurer Rhonda Klatt, Sherman residents Jim Schulz, Phillip Beuscher, Pat Horne, Transfer Station Attendant Karl Heichler, Building Inspector Walt Grotelueschen, Constable Jeff Kreutzinger, Sheboygan County Sheriff’s Deputy Jason Brockway, Parks Committee Chair Dennis Hiller and Reporters Rodney Schroeter and Bernadette Mondloch

3. BUDGET PUBLIC HEARING: Discussions were held on the proposed 2011 budget as presented. Chairman Goehring noted that the bottom line is the levy is up 3% (from last year), and the highest increase is in Public Works, mainly due to the high costs of asphalt and other necessary materials for (building/repairing) roads.

4. ADJOURN: Hearing no further comments from the public, Chairman Goehring closed the public hearing at 7:04 p.m.

The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

2. APPROVE 2010 HIGHWAY EXPENDITURES: Motion by Phillip Beuscher, seconded by Jim Schulz, all voting in favor to approve the 2011 Highway Expenditures, for $172,571, pursuant to Section 82.03(3) of the Wisconsin State Statutes, motion carried 12-0.

3. APPROVE 2010 TOWN TAX LEVY: Motion by Phillip Beuscher, seconded by Jim Schulz, all voting in favor to approve the 2010 Town Levy to be collected in 2011, in the amount of $282,531, pursuant to Section 60.10(1)(a) of the Wisconsin State Statutes, motion carried 12-0. ($2.04 per $1,000 of assessed valuation)

4. ADJOURN: Motion by Jeff Kreutzinger, seconded by Jim Schulz, all voting in favor to adjourn the meeting of the electors, motion carried 12-0. Time: 7:08 p.m.

1. CALL TO ORDER: Town Chairman William Goehring called to order the Board of Supervisors Monthly Meeting by calling to order at 7:09 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department. Some items may have been taken out of agenda order as announced at the start of the meeting.

3. APPROVAL OF MINUTES: Motion by L. Miller, seconded by Fahney, all voting in favor to approve the minutes from the October 6, 2010 monthly meeting with corrections, motion carried 5-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: Sherman Resident Jim Schulz asked if it would help (the budget) if the town were to “cut back” on mowing by the county. Supervisor L. Miller noted, “The town cut back last year already, so we can’t anymore. Some spots were a little worse than others were earlier this year. There are so few areas where we can save money, so we try to be fiscally responsible for the town.”
Sherman resident Phil Beuscher asked that the board please reconsider my request from the last meeting (see minutes from Oct. 6, 2010) and to extend the path to Town Line Road from Cimmeron. Supervisor L. Miller said “That may be something that the town would have to do on its own because the plan is already in place. It may be awhile before that does happen though.”

6. BUILDING INSPECTOR REPORT: Motion by Fahney, seconded by Boehlke, all voting in favor to approve the building inspector’s report as presented, motion carried 5-0.

7. CONSTABLE REPORT: Sheboygan County Sheriff’s Deputy Brockway spoke to the board about Russell Reyson’s fence issues on CTH I. “Twenty-four visits have been made to the property since 2003, with six alone in this year. Being a renter, he is still responsible for keeping the fence in good shape. The last time I spoke with him, he was issued a misdemeanor citation. The town could now be held responsible in any accidents resulting in injuries that may occur there because of the fence condition, and that the town has now been made aware. The property is located on a county highway, however the fence “is not on the highway”, so it is not a county issue.” Deputy Brockway presented the fencing state statutes and gave a brief explanation of the assessment of a fence. It was the consensus of the board the Chairman Goehring will contact Attorney Ed Ritger to learn of the proper avenues the board can take.

9. NEW BUSINESS:
a. 2011 Budget, Approval and Adoption: Motion by W. Miller, seconded by L. Miller, all voting in favor to approve and adopt the 2011 Budget as presented, motion carried 5-0. A full copy of the new budget shall follow these minutes in the minute book.


b. 2011 Insurance Carrier, Approval: Motion by L. Miller, seconded by Fahney, all voting in favor to approve 2011 Insurance Carrier as Rural Mutual Insurance, motion carried 5-0.

c. Joint Powers Agreement: Motion by Fahney, seconded by Boehlke, all voting in favor to accept the 2011 Joint Powers Agreement County 911 Emergency System, motion carried 5-0.

d. Liquor License Applications: No licenses were to be considered this month.

e. Next regular meeting date: December 7, 2010 at 7:00.

10. TOWNCHAIR REPORT: Chairman Goehring commented on the 2.53% county levy tax increase and that the Board of Appeals will be meeting again to discuss the Mudlaff case. He also invited members of the board to a Farmland Preservation & Planning session in Fond du Lac on December 6.

11. REPORTS OF TOWN COMMITTEES:
a. Boehlke & W. Miller, Transfer Station: Supervisor Boehlke noted that a load of gravel was spread on the transfer station site by Howie Mitchell, and that Mitchell had asked if he could take care of snow plowing the site this season. Supervisor L. Miller will contact the county to tell them to discontinue past practice of plowing the site. Attendant Heichler inquired about the possibility of him handing out dump tags at the site rather than the clerk having to mail them. It was the consensus of the board to continue having the clerk mail them out so she is able to verify residency prior to mailing.
b. L. Miller & Fahney, Roads: A few potholes on Bates Road were repaired.
c. Bill Beverly, Plan Commission: In the absence of Plan Commission Chairman Beverly, Clerk-Treasurer Klatt announced that there would be a meeting on Thursday, November 11 at 7:45 p.m.
d. Dennis Hiller, Park Board: Hiller asked where residents are supposed to get rid of brush and yard wastes. Discussion was held on various options, and it was decided that it would become a proper agenda item next month. Hiller was commended on the wonderful job he has done with Hiller Park this year.

12. MISCELLANEOUS BUSINESS:
e. Clerks Communications: Clerk-Treasurer Klatt mentioned that there was no change in the final 2010 population, as it remains at 1,571, and there was a 76% voter turnout at yesterday’s election.


13. ADJOURN: Motion by Fahney, seconded by L. Miller, all voting in favor to adjourn. Motion carried 5-0. Time: 8:28 pm
