1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

2. ROLL CALL:
Members Present: Town Chairman William Goehring, Town Supervisors Lester Miller, William Miller, James Fahney, Robert Boehlke
Members Absent: none

3. APPROVAL OF MINUTES: Motion by L. Miller, seconded by Fahney, all voting in favor to approve the minutes from the September 1, 2009 meeting as presented with corrections, motion carried 5-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by Fahney, seconded by W. Miller, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: Jeff Hanke asked the board if he would be given permission to construct a storage building on his property prior to a dwelling. It was the consensus of the board that given there is no ordinance in place to prohibit such order of construction, he should apply for a permit for both dwelling and storage building simultaneously in order to construct the storage building, but does not have to build the dwelling immediately. Permits that are issued are valid for two (2) years. If permit expires before beginning construction, a new application must be made.

6. BUILDING INSPECTOR REPORT: Motion by Boehlke, seconded by W. Miller, all voting in favor to approve the building inspector’s report as presented. Motion carried 5-0.

7. CONSTABLE REPORT: It was noted that the constable has been given a list of names of noncompliant dog owners who have not applied for a 2009 license. Constable Kreutzinger will be going door-to-door to notify the owners of their requirements. It was also noted that the constable made a special stop at a contractor site in which a small section of Silver Creek/Cascade Road had been damaged. Supervisor L. Miller recommends the constable be paid for his time spent checking out the situation.

8. UNFINISHED BUSINESS:
a. Update on Country Meadows Estates, Drainage Issues: No action taken on this item.

9. NEW BUSINESS:
a. Conditional Use Permit, Sprinkmann: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the conditional use permit for Todd Sprinkmann, N1347 Lynn Road, for an existing personal-use tower which was constructed in 2005, with the following conditions:, motion carried 5-0.
i. (1) Renewal of conditional use permit shall be required when ownership of property transfers;
ii. (2) Conditional Use Permit will be valid for (2) two years, and shall be renewed at that time; and
iii. (3) If conditional use permit is not renewed at expiration, tower shall be removed within ninety (90) days.

b. Lakeview Community Library, Request for Additional Funds: Motion by W. Miller, seconded by Fahney, all voting in favor to table the request for additional funds until Chairman Goehring has attended an October 13, 2009 meeting to learn more, motion carried 5-0.

c. Request for funding from Sheboygan County Economic Development Corporation: Motion by L. Miller, seconded by W. Miller, all voting in favor to reject the request for funding from the Sheboygan County Economic Development Corporation based on budget restraints, motion carried 5-0. Clerk/Treasurer Klatt was instructed to send the corporation a letter stating such decision.

d. Possible Town Website Planning: An estimate from a developer was discussed, and determined too expensive. Clerk/Treasurer Klatt will look into other developers; no further action taken on this item.

e. Veolia Environmental Services, Contract Proposal: Motion by L. Miller, seconded by Fahney, all voting in favor to open the trash/recycle hauling contract to bids rather than accepting the contract extension from Veolia, motion carried 5-0.

f. Preliminary 2010 Budget: Motion by W. Miller, seconded by Fahney, all voting in favor to accept the preliminary 2010 budget as presented, and to publish the public hearing notices using the presented figures, motion carried 5-0.

g. Liquor, Cigarette and Operator Licenses:
i. “Class A” Combination Beer and Liquor, Arushupinder Chahal, MSM Chahal, N511 State Hwy. 57, Random Lake: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the license, motion carried 5-0.
ii. Eliza Lenzner, 643 Hwy BB, Adell, Greene’s Bar & Grill: Motion by L. Miller, seconded by Boehlke, all voting in favor to approve the operator license, motion carried 5-0.
h. Next Meeting Date: November 3, 2009

10. TOWNCHAIR REPORT: Items for discussion only.

11. REPORTS OF TOWN COMMITTEES:
a. Boehlke & W. Miller, Transfer Station: Nothing to report at this time.

b. L. Miller & Fahney, Roads: Miller stated the center lining on Bates, East/West Bates and Lynn Roads have been completed. The Sheboygan County Highway Department will make repairs to Silver Creek/Cascade Road, damaged by CF Construction, Manawa, Wisconsin, to whom the bill will be sent for reimbursement.

c. Bill Beverly, Plan Commission: Nothing to report at this time.

d. Dennis Hiller, Park Board: Hiller reported that the park had a good season, and an increasing number of children are utilizing it.

12. MISCELLANEOUS BUSINESS:
a. Clerk’s Communications: Nothing to report on this item.

13. ADJOURN: Motion by W. Miller, seconded by Fahney, all voting in favor to adjourn. Motion carried 5-0. Time: 8:07 pm
