1. CALL TO ORDER: Town Chairman William Goehring opened the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department.

2. ROLL CALL:
Members Present: Town Chairman William Goehring, Town Supervisors Lester Miller, William Miller, James Fahney, Robert Boehlke

3. APPROVAL OF MINUTES: Motion by Fahney, seconded by L. Miller, all voting in favor to approve the minutes from the August 4, 2009 meeting as presented, motion carried 5-0.

4. APPROVAL OF FINANCIAL REPORT: Motion by W. Miller, seconded by Fahney, all voting in favor to approve the financial report as presented, motion carried 5-0.

5. PUBLIC INPUT: No comments were heard.



6. BUILDING INSPECTOR REPORT: Motion by Boehlke, seconded by W. Miller, all voting in favor to approve the building inspector’s report as presented. Motion carried 5-0.
a. 08-09-01 Robert Michaels N261 Lynn Road Raze Garage, New Storage Shed

7. CONSTABLE REPORT: Discussion was held on the possible habitation of a trailer located near County Road A and Bates Road. Building Inspector Mayer had been on the property earlier on a different matter, and did not notice any one there at the time. The board instructed Mayer to be aware of the possibility, and to report back if he notices any activity there. Discussion was further held on an emailed complaint from Kris Pannier, Sherman resident, on a neighbor burning large items, including campers. Building Inspector Mayer stated that this is DNR regulated, and she should contact the DNR next time she notices the activity.

8. UNFINISHED BUSINESS:
a. Update on Country Meadows Estates, Drainage Issues: Chairman Goehring stated that Attorney Ritger, Goehring, subdivision engineers and the Sheboygan County Conservation Department reviewed the drainage issue and plans. He further stated, “The county regulations are much stronger when it comes to run-off to neighboring properties than are the DNR regulations. Attorney Ritger and I both agree that these plans meet the county’s standards for run-off.” The final plat approval has been put on hold for tax purposes. No further action taken on this item.

9. NEW BUSINESS:
a. Capetillo, Request for Information: Mr. Efrem Capetillo Jr. purchased approximately 50 acres on the southeast corner of Highways A & I. He stated that although he is not looking to build now, he would still like to be allowed to clear a “path” wide enough for vehicular access to an existing shed in the middle of the property for hunting. The town board was in consensus that he would be required to obtain a permit from Sheboygan County to gain access off a county highway, but complies with Sherman Zoning Code. (The 300’ setback ordinance was in question, but because Capetillo is not constructing a dwelling, the ordinance does not apply.)
b. Appointment of Lakeview Library Representative: Motion by Boehlke, seconded by Miller, all voting in favor to appoint Katherine Pannier Smith as the Lakeview Library Representative, motion carried 5-0. On behalf of the library, Representative Sara Filemyr thanked the town board for their continuing support, and further mentioned that Director Darla Jean Kraus had received the 2009 Muriel Fuller Award. The Muriel Fuller Award is given to a library professional or paraprofessional in recognition of outstanding accomplishments that have significantly improved and benefited library services. Motion by W. Miller, seconded by Boehlke, and voting in favor to congratulate Ms. Kraus for a job well done, motion carried 5-0.
c. 2009/2010 Tax Collection Agreement: Motion by W. Miller, seconded by Fahney, all voting in favor to sign into agreement the collection of the 2009 tax roll will be handled by the Sheboygan County Treasurer, as in the past two years, motion carried 5-0.
d. Resolution for Exemption of Library Tax: Motion by L. Miller, seconded by Boehlke, all voting in favor to approve Resolution #2009-02, Exemption of Library Tax, motion carried 5-0. The Town of Sherman will, during 2010, expend for a library fund, an annual amount at least equal to the sum, which it would have to pay toward the 2009 Sheboygan County Library tax levy. The 2010 amount will be $41,470, to be paid directly to the Lakeview Community Library quarterly.
e. (2) Plan Commission Appointments: Motion by W. Miller, seconded by Fahney, all voting in favor to appoint David Heidel and James Schulz, Alternate, to a three year term, expiring September 2012, motion carried 5-0.
f. Preliminary 2010 Budget: Clerk/Treasurer Klatt presented a preliminary budget to the board. While some figures have not yet been received for shared revenue and general transportation aids, the board instructed her to place this item on next month’s agenda for further review.
g. Liquor, Cigarette and Operator Licenses:
i. Motion by W. Miller, seconded by L. Miller, Fahney abstaining, most voting in favor to approve Operator License for Pamela Staaben, N138 County Road LL, Cedar Grove, motion carried 4-0.
h. Next Meeting Date: October 6, 2009

10. TOWNCHAIR REPORT: Items for discussion only.

11. REPORTS OF TOWN COMMITTEES:
a. Boehlke & W. Miller, Transfer Station: The fire number tile has been installed on the front gate of the station. Attendant Heichler was noted as requesting a way to compact paper; the board took no action on this request.
b. L. Miller & Fahney, Roads: Miller stated the Scott Construction completed the seal coating on East/West Bates Road, but has not been center-lined yet. Brush cutting will be conducted near the middle of September. Random Lake Road path will not happen this year. The line striping on Lynn Road is very light, and should be repainted soon. Miller figured about $65/mile for yellow paint for 5 miles.
c. Bill Beverly, Plan Commission: Beverly noted that Todd Sprinkmann has applied for a conditional use permit for an existing tower, which was recommended by the plan commission. He further stated that the commission looked into “penalty ordinances”, as requested by the board in August, and it was found that Ordinance #2.6 should meet the terms of anyone who was found to complete projects, construct buildings, etc., without first obtaining a building permit or permission from the town board. SECTION 2.6 PENALTIES: Any person, firm, or corporation who fails to comply with the provisions of this ordinance shall, upon conviction thereof, forfeit not less than fifty dollars ($50.00) nor more than two hundred dollars ($200.00) and costs of prosecution for each violation and in default of payment of such forfeiture and costs, shall be imprisoned in the County Jail until payment thereof, but not exceeding thirty (30) days. Each day a violation exists or continues shall constitute a separate offense.
d. Dennis Hiller, Park Board: It was the consensus of the board that since there was dollars budgeted for Parks, Hiller should be allowed to expend money towards the purchase of a rope ladder, and other necessities for the park. Clerk/Treasurer Klatt will notify him of the approval.

12. MISCELLANEOUS BUSINESS:
a. Clerk’s Communications: Nothing to report on this item.

13. ADJOURN: Motion by W. Miller, seconded by Fahney, all voting in favor to adjourn. Motion carried 5-0. Time: 8:25 pm
