1. CALL TO ORDER: Town Chairman William Goehring called to order the Board of Supervisors Monthly Meeting by calling to order at 7:00 pm at the Silver Creek Fire Department. The meeting was held in compliance with the open meeting law having been posted at the National Exchange Bank in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire Department. Some items may have been taken out of agenda order as announced at the start of the meeting.
2. ROLL CALL:
Members Present: Town Chairman William Goehring; Town Supervisors Lester Miller, William Miller, James Fahney and Robert Boehlke
Members Absent: none
Others Present: Clerk/Treasurer Rhonda Klatt, UW-Extension Community Resource Development Agent Dave Such, Plan Commission Chair Bill Beverly, Sherman residents Jim Shultz, Building Inspector Walt Grotelueschen, and Reporters Rodney Schroeter and Bernadette Mondloch.
3. APPROVAL OF MINUTES: Motion by Fahney, seconded by W. Miller, all voting in favor to approve the minutes from the August 3, 2010 monthly meeting as presented, motion carried 5-0.
4. APPROVAL OF FINANCIAL REPORT: The Financial Report (summary of to-date budget) was included with the 2011 Preliminary Budget (see item # 9f), and will be dealt with at a later time in this meeting.

5. PUBLIC INPUT: None.
6. BUILDING INSPECTOR REPORT: Motion by Fahney, seconded by W. Miller, all voting in favor to approve the building inspector’s report as presented, motion carried 5-0.

7. CONSTABLE REPORT:
a. Barking Dog Issues: Constable Jeff Kreutzinger spoke with the board regarding “the place on SS”. No written reports or complaints have been given from other residents, however, many verbal reports have been given. He said that the barking of the dogs from that property has been all night, every night, continuously. Chairman Goehring said that the town board is still working on an ordinance, and it may be awhile yet before something is in place. The constable further mentioned that he was told by another Sherman resident that there is no one residing in the house right now, but there is definitely a business there, and the car that is parked out front of the house has not moved in months.
b. Sheboygan Co. Sheriff’s Department, Reyson Mandatory Fence Repair: Speaking on behalf of Deputy Jason Brockway, Constable Kreutzinger stated that since 2006 the sheriff’s department has received fourteen (14) calls addressing animals on the road in front of the property in which Russell Reyson rents farm space (N1742 Highway I). Because Deputy Brockway feels that the sheriff’s department is unable to issue a ticket to Reyson, the board ordered Clerk/Treasurer Klatt to write a letter to Reyson, asking him to bring the fence up to standard conditions within a certain time frame.
c. Other: Motion by L. Miller, seconded by W. Miller, all voting in favor to authorize Constable Kreutzinger to purchase a uniform shirt or jacket for his role as constable to announce his position, motion carried 5-0. The constable was informed by the sheriff’s department that more of the minor complaints will be passed to him, and away from the county.
8. UNFINISHED BUSINESS:
a. Proposed Dog Ordinance: (this item was moved to the end of the agenda, yet the discussion is as follows) A review was made of the responses from Attorney Gerald Kiefer regarding the proposed dog ordinance. The adhoc committee (Les Miller, Jim Fahney and the clerk) will meet on September 22, 2010 to discuss more in detail, and report back to the board in October.
9. NEW BUSINESS:
a. Authorization for Dave Such, UW-Extension to Use Meeting Room for Water Testing/Collection Site: Motion by L. Miller, seconded by Fahney, all voting in favor to approve Dave Such’s use of the town meeting room on September 20, 2010 from 8:00 a.m. to 1:30 p.m. for town residential water testing/collecting, motion carried 5-0.
b. Set Date for Insurance Review: It was the consensus of the board to invite Gary Fischer, Rural Mutual Insurance Agent, to a review meeting on September 22, 2010 at 7:00 p.m., pending acceptance by Fischer.
c. Appointments to Plan Commission: Motion by Goehring, seconded by Boehlke, all voting in favor to reappoint William Beverly, Kerry Lynch, William Miller and James Fahney to the plan commission for a three-year term, term to expire in 2013, motion carried 5-0. After the meeting was held, Chairman Goehring noticed a problem with the appointment of two of the members.. Fahney and Miller had been reappointed in 2008 for a three-year term (expires in 2011). Those appointments today will be stricken from the record.
d. Resolution #2010-04 Exemption from Library Tax: Motion by Fahney, seconded by L. Miller, all voting in favor to approve the Resolution #2010-04 Exemption from Library Tax, motion carried 5-0.

TOWN OF SHERMAN
RESOLUTION FOR EXEMPTION OF LIBRARY TAX
Be advised that pursuant to Section 43.64(2) Wisconsin Statutes, the Town of Sherman hereby makes written application to be exempted from the Eastern Shores Library tax levy for 2010, payable 2011.
Note that the Town of Sherman will expend, during 2011, for a library fund, an annual amount at least equal to the sum, which it would have to pay toward the 2010 Sheboygan County Library tax levy.
Said Library fund of $42,742 shall be used to pay for the Town of Sherman’s obligation under the Lakeview Community Joint Library Agreement.

e. Union Cemetery: Supervisor W. Miller said the board needs to discuss the current fees for gravesites, etc, “which probably hasn’t changed in fifty (50) years”. He says the entire board should be involved, and the Clerk/Treasurer Klatt should keep the files in the town office. It was the consensus of the board for a meeting to be scheduled on the same night as the insurance review, September 22, 2010, and the clerk was ordered to notice the meeting accordingly.
f. Preliminary 2011 Budget: (this item was moved to the end of the agenda, yet the discussion is as follows) Suggested changes to the presented preliminary budget was a 1% increase in the clerk’s wages as well as public safety (fire departments and ambulance services), increase mowing budget of “mowing” to $10,000, and to add a new line (#64?) entitled “Compacting” $1200 which would pay Howie Mitchell (currently) for compacting the dumpsters at the transfer station. ($100 a month to be paid to Mitchell)
g. Liquor License Applications No licenses were to be considered this month.
h. Next regular meeting date: It was the consensus of the board to change the next meeting date to Wednesday, October 6, 2010 at 7:00 p.m.
10. TOWNCHAIR REPORT: Chairman Goehring would like to encourage residents to call either himself or the Sheboygan Press to report the “blue tubes’ (free newspapers that were prohibited by last month’s ordinance Title 11, Chapter 3 Distribution of Handbills and Newspapers.
11. REPORTS OF TOWN COMMITTEES:
a. Boehlke & W. Miller, Transfer Station: All electronic materials were shipped out before September 1, when the new e-waste law came into effect.
b. L. Miller & Fahney, Roads: Lawn clipping will start in mid-September. Center lines are pretty bad on some roads.
c. Bill Beverly, Plan Commission: An October meeting has been tentatively scheduled.
d. Dennis Hiller, Park Board: Hiller not in attendance; nothing to report on this item.
12. MISCELLANEOUS BUSINESS:
e. Clerks Communications: It was determined that Boehlke and Fahney are the supervisors who will be attending the WTA Annual Convention in LaCrosse in October.
There was not a need for a closed session, as noticed on the agenda.
13. ADJOURN: Motion by W. Miller, seconded by Fahney, all voting in favor to adjourn. Motion carried 5-0. Time: 8:48 pm
