1.	CALL TO ORDER:  Town Chairman William Goehring opened the Board of
Supervisors Public Hearing by calling to order at 7:00 pm at the
Silver Creek Fire Department.  The meeting was held in compliance with
the open meeting law having been posted at the National Exchange Bank
in Adell, Adell Mini Mart, Midway Mart and the Silver Creek Fire
Department.  Some items may have been taken out of agenda order as
announced at the start of the meeting.
 
2.	ROLL CALL:  
Members Present:  Town Chairman William Goehring; Town Supervisors
Robert Boehlke, Pat Horne and Kris Klein
Members Absent: James Fahney
Others Present:  Clerk/Treasurer Rhonda Klatt, Sherman residents

3.	Conditional Use Permit Application by Matthew Eischen:  Discussion
was held regarding the application for an auto repair, salvage and
sales business at N511 State Highway 57, Random Lake.  Resident and
neighbor, Brenda Binder, spoke of concerns of how late in the evenings
the business would be operating.  She presented pictures to the board
showing how close her bedroom window is to the area of where the
business will be.  Chairman Goehring asked what she felt would be
reasonable operating hours, to which she suggested no later than 9:00
p.m.  When she confirmed that she would agree to 9:00 p.m. as a
reasonable time, she further stated that a privacy fence of sort would
be ideal to separate her backyard from view.  Supervisor Horne spoke
briefly of the type of license Eischen would be obtaining from the
State of Wisconsin.  “He states in his application that a Type 4
license is what he will be getting, but according to this information
from the state, it appears that a Type 2 license is more what he
needs.  As no further comments were heard, Chairman Goehring closed
the hearing at 7:10 p.m.  Eischen was not in attendance at this time,
so he was unable to answer any specific questions regarding the
application.  He appeared in front of the board at approximately 7:40
p.m.  See the following minutes (*) for more information.

3.	APPROVAL OF MINUTES:  Motion by Klein, seconded by Horne, all
voting in favor to approve the minutes from the May 3, 2011 Regular
Monthly Meeting, motion carried 5-0.  

4.	APPROVAL OF FINANCIAL REPORT:  Motion by Boehlke, seconded by
Klein, all voting in favor to approve the financial report as
presented, motion carried 5-0.

5.	PUBLIC INPUT:  Resident Jim Schulz commented that Supervisor Klein,
being an employee of the Sheboygan County Highway Department,
“really had the guys on the ball!”  Schulz had been waiting for
quite some time to have some trees removed, and the county had taken
care of it just recently.

6.	BUILDING INSPECTOR REPORT:  Inspector Grotelueschen stated that he
has learned nothing more regarding the driveway on County Road SS, but
will let the board know when he does.  Motion by Boehlke, seconded by
Klein, all voting in favor to accept the Building Inspector’s Report
and to approve the permit applications, motion carried 5-0.

7.	CONSTABLE REPORT:   None

8.	UNFINISHED BUSINESS:
a.	Mowing of Wayside Parkland:  Two bids were received for the mowing
of the parkland.  The job was awarded to low bidder, Mike Kirmse, for
$337.50 for the season.

b.	Sale of Trash Bags at the Transfer Station:  It was the consensus
of the board to remove this item from the agenda, as it seems there
are too many other issues that are in need of resolution before this. 
No further action taken.

9.	NEW BUSINESS:
	
a.	 Conditional Use Permit Application by Matthew Eischen:  Motion by
Boehlke, seconded by Klein, all voting in favor to grant a conditional
use permit to Matthew Eischen to have an auto repair, salvage and
sales business at N511 STH 57, Random Lake, with the following
conditions, motion carried 5-0:
i.	A privacy fence must be installed around concrete pad on the north
side of building (to separate from neighbor’s backyard);
ii.	Business/Operating hours are not begin prior to 6:00 a.m., nor
continue past 9:00 p.m.;
iii.	No more than ten (10) vehicles for sale, service or for scrap,
are to be on the property at one time;
iv.	The proper licensing (either a Type 2 or Type 4) must be obtained
from the State of Wisconsin, WI DNR and any other license grantors,
which shall be consistent with the activities of business;
v.	Comply with all county regulations;
vi.	Permit to be valid for two (2) years, and shall be renewable if
all conditions are met; and
*It was the consensus of the board that if any complaints are received
regarding the business activity, or the condition of the property,
Eischen will be asked to speak to the town board.

b.	Bridge Aid Requests:  Per the ratings of the town bridges, (Silver
Creek/Cascade 28.5, West Creek 33.0), Supervisor Klein will obtain an
estimate from the county highway department for the replacement of the
West Creek Road bridge.  Although West Creek Road bridge has a higher
rating, it is a very narrow bridge and should be widened and replaced.
 Silver Creek Cascade Road bridge, per Klein, should last for many
years simply due to the way it is built.  The board will then proceed
at the July meeting to discuss the application for bridge aid, to
which the town will be responsible for 10% of the costs. (A bridge
must have a rating below 50 to be eligible for bridge aid.)

c.	Risse/Heimerl Boundary Dispute:  Supervisor Horne had received a
call from Jane Risse regarding the easement on Heimerl’s property to
access her own, and concerns of trees in need of trimming, snow
fencing and No-Trespassing signs being placed by the neighbor. 
Chairman Goehring stated that when this situation arose in the past,
the town’s attorney advised that since it is on private property,
the town cannot really get involved in it.  It was asked if the
Risse’s should contact the fire department to see if the trees
encroaching on her driveway (which is on the easement) would pose a
hazard, and eventually seek legal advice.  No further action taken on
this item.

d.	Ordinance #2011-01 Establishing Municipal Ward Boundaries:  Motion
by Boehlke, seconded by Horne, all voting in favor to approve
Ordinance 2011-01 Establishing Municipal Ward Boundaries due to a
county requirement, motion carried 5-0.  The County Board adopted
their Tentative County Supervisory District Plan and is now
designating the development of municipal ward boundaries.  Copy of
ordinance shall be inserted in this book following these minutes.

i.	Motion by Boehlke, seconded by Klein, all voting in favor to
approve the following liquor and operator licenses, motion carried
5-0.

10.	TOWN CHAIRMAN REPORT:  (1) As reported at the May meeting, only
one bid for the bike path project was received, and it was thought the
state government (grantor) may not allow the acceptance of the bid
because there was nothing to compete with.  This, however, has been
determined to be allowed and the bid was accepted.  (2) The
non-participating portion of the Random Lake Road project came in at
$18,000, lower than the engineer estimated, however the participating
portion (the paths) came in higher than estimated.  The County
Committee overseeing the expenditures of the Federal grant project
approved additional funding from that source.  The bike path may begin
in June of this year.

11.	REPORTS OF TOWN COMMITTEES:
a.	Transfer Station:  Clerk/Treasurer Klatt will draft a
“checklist” for attendants to use when residents bring in larger
items that should be charged a fee for collection.   Several
suggestions were made concerning the collection of bigger items, and
the possibility of having a binder with regulations for attendants’
use.  Clerk/Treasurer Klatt was asked to invite attendant Heichler to
the July meeting.
i.	Area Transfer Station Fees:  Supervisor Horne presented a
compilation of area site fees, and it was determined that our fees are
rather low.
ii.	Proposed Fee Schedule:  Item tabled until more information can be
collected.

b.	Roads: (1) It was asked if it was required if only the county may
sell and install a culvert to a resident, and the answer was no.  A
resident can purchase a legal culvert anywhere they prefer and install
it themselves.  (2) The spray painting of a bridge will be placed on
the July agenda.  (3) Motion by Horne, seconded by Boehlke, all voting
in favor to accept the crackfilling of East/West Bates Road, Allen
Road and Camp Awana Road bid from the county highway department for
$6,876, motion carried 5-0.  The other bid received was from Herrling
and was for “not to exceed $7,500”.

c.	Bill Beverly:  Plan Commission:  Nothing was reported at this
time.

d.	Dennis Hiller:  Park Board:  Hiller not in attendance; no action
taken on this item.

12.	MISCELLANEOUS BUSINESS:
a.	Clerk’s Communications
i.	The clerk’s office will be closed June 20 – 22.
ii.	Motion by Goehring, seconded by Klein, all voting in favor to
approve Klatt’s request to attend the Annual Clerk’s Conference in
August, motion carried 5-0.
iii.	Klatt will contact former members Lester Miller and William
Miller to decide on a date and location for a retirement dinner.

13.	ADJOURN:  Motion by Klein, seconded by Horne, all voting in favor
to adjourn.  Motion carried 5-0.  Time:  9:10 pm
